Who Is Liable After a Horse Crash in California? By Legal Commentary by Emile Davis on May 12, 2026

Merced Man and Three Passengers Seriously Injured After Highway 41 Horse Crash

According to local reports, the crash happened on May 6, 2026, around 3:57 a.m. on State Route 41 south of Mecca Lane, south of Coarsegold. CHP reported that a horse was standing in the highway when one vehicle had stopped, and another vehicle struck the horse before colliding with the stopped vehicle and going down an embankment. The driver and three passengers in the Accord were transported by air ambulance with moderate to major head injuries, while the CR-V driver suffered minor to moderate injuries.

Legal Insights from Emile A. Davis

Owners of horses and other livestock may be liable for negligence when their animals stray onto a highway if the owner failed to use reasonable care to fence in the animals. See, e.g., Galeppi Bros., Inc. v. Bartlett, 120 F.2d 208 (9th Cir. 1941). However, California Food and Agricultural Code section 17124 allows counties to declare that a county, or part of a county, is devoted chiefly to grazing.

This distinction makes sense because what may be reasonable for fencing in a rural community may not make sense in a city like San Francisco. Importantly, drivers approaching horse-drawn vehicles, ridden animals, or livestock must exercise proper control of their vehicle and reduce speed or stop when necessary to avoid frightening the animal and to protect public safety. See California Vehicle Code section 21759.
